Agreement to Terms
By accessing or using the Pacific Islands Disaster Alert System (PIDAS), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms constitute a legally binding agreement between you and PIDAS regarding your use of our disaster alert services.
Service Description
PIDAS is a disaster monitoring and alert system that provides information about natural disasters in the Pacific Islands region. Our services include:
- Real-time disaster monitoring and detection
- Personalized alert delivery via email, SMS, and push notifications
- Geographic filtering based on user-specified locations
- Disaster information and safety instructions
- Historical disaster data and mapping
Important Disclaimers
Emergency Services Disclaimer
PIDAS is NOT an emergency service and is not monitored 24/7 for emergency response. In life-threatening situations, contact your local emergency services (911, 999, etc.) immediately.
Supplemental Information Only
PIDAS provides supplemental disaster information and should not replace official emergency management guidance. Always follow instructions from local authorities and official disaster management agencies.
No Guarantee of Service
While we strive to provide accurate and timely information, we cannot guarantee:
- 100% accuracy of disaster information
- Delivery of all alerts to all users
- Continuous service availability
- Complete coverage of all disaster events
User Responsibilities
Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- Providing accurate contact information for alert delivery
- Updating your location and preference settings as needed
- Notifying us immediately of any unauthorized account access
Appropriate Use
You agree to:
- Use PIDAS only for legitimate disaster preparedness purposes
- Not attempt to interfere with or disrupt our services
- Not use automated systems to access our services excessively
- Comply with all applicable laws and regulations
Emergency Preparedness
Users should:
- Develop comprehensive emergency plans beyond relying on PIDAS
- Stay informed through multiple official information sources
- Follow local emergency management guidance
- Test alert delivery regularly using our test alert feature
Service Availability
PIDAS is provided on an "as available" basis. We may:
- Temporarily suspend service for maintenance or updates
- Modify or discontinue features with reasonable notice
- Experience service interruptions due to technical issues
- Limit service access during extreme events to ensure system stability
We will make reasonable efforts to provide advance notice of planned service interruptions when possible.
Data and Privacy
Your use of PIDAS is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection, use, and sharing of information as described in our Privacy Policy.
Key privacy principles include:
- We do not sell your personal information
- Location data is used solely for disaster alerting purposes
- You can access, modify, or delete your account data at any time
- We implement strong security measures to protect your information
Prohibited Uses
You may not use PIDAS to:
- Distribute false disaster information or create panic
- Interfere with emergency response operations
- Attempt to gain unauthorized access to our systems
- Use our services for commercial purposes without permission
- Harass, abuse, or harm other users
- Violate any applicable laws or regulations
- Reverse engineer or attempt to extract our algorithms
Intellectual Property
All content, features, and functionality of PIDAS, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are owned by PIDAS or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, distribute, or create derivative works from our content
- Use our trademarks without prior written permission
- Remove or alter any proprietary notices
Third-Party Services
PIDAS integrates with third-party data sources and services, including:
- USGS Earthquake Hazards Program
- NOAA National Weather Service
- Email and SMS service providers
- Mapping and geolocation services
We are not responsible for the availability, accuracy, or policies of third-party services. Your use of such services may be subject to separate terms and conditions.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- PIDAS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM
- WE MAKE NO WARRANTIES REGARDING SERVICE AVAILABILITY, ACCURACY, OR RELIABILITY
- YOU ASSUME ALL RISKS ASSOCIATED WITH YOUR USE OF EMERGENCY INFORMATION
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless PIDAS and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:
- Your use or misuse of PIDAS services
- Your violation of these Terms
- Your violation of any third-party rights
- Your negligent or wrongful conduct
Termination
Either party may terminate this agreement at any time:
User Termination
You may terminate your account at any time by deleting your account through our service or contacting us directly.
Service Termination
We may suspend or terminate your access if you:
- Violate these Terms
- Engage in prohibited activities
- Provide false information
- Fail to respond to service communications
Upon termination, your access to services will cease, and your data may be deleted according to our retention policy.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Email notification to registered users
- Prominent notice on our website
- In-service notifications
Your continued use of PIDAS after changes take effect constitutes acceptance of the new Terms.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with applicable international laws and the laws of the jurisdiction where PIDAS operates. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

By using PIDAS, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. You also acknowledge that natural disasters are unpredictable events and that no alert system can provide 100% protection or guarantee of safety.
